A request by a high-profile man accused of rape to access months of data from his alleged victim’s mobile phone is still being considered.
The latest in a string of committal mentions took place in Toowoomba Magistrates Court on Wednesday to determine if there was enough evidence to proceed to trial.
The high-profile man, who is on bail and cannot be named for legal reasons, faces two charges of raping a woman in October 2021.
Prosecutors had previously agreed to multiple adjournments in line with the accused’s request for a forensic medical report and a download of data from the complainant’s phone.
The medical support had now been supplied, but prosecutor Sarah Dreghorn told the court the parties were still negotiating over mobile phone data access.
The court previously heard the defence had requested data for the six months prior to the event’s date.
Ms Dreghorn said on Wednesday they had received the defence’s request two weeks ago for “parts of the complainant’s phone download”.
“My principal replied … asking for an articulation why the material is disclosable,” she said.
Prosecutors received the defence’s submission on that issue last week, she said.
Ms Dreghorn added the request was still being considered, but the defence should have a response within a week.
Magistrate Louise Shephard adjourned the matter until August 23.
